§ 01 The Structural Case
The EU's regulatory architecture — GDPR, EU AI Act, DORA, NIS2, EHDS, Legal Professional Privilege — was designed before frontier AI existed. Every one of these frameworks implicitly prohibits routing sensitive professional data through US-domiciled infrastructure subject to the US CLOUD Act.
US law requires US-domiciled cloud providers to disclose data to US authorities on demand — regardless of where the data physically sits. Any regulated EU firm using AWS, Azure, or GCP for privileged data is in continuous potential breach of EU data protection law.
Article 52 requires high-risk AI systems to maintain explainability, audit trails, and human oversight mechanisms that are impossible to guarantee when inference runs on opaque third-party infrastructure.
